Justice O.S. Oloyede extends Ogun land injunction, restraining Governor Dapo Abiodun and firms from trespassing on Ilara Remo community property

Justice O.S. Oloyede of the Ogun State High Court sitting in Sagamu has extended by three months an interim injunction restraining Governor Dapo Abiodun, his agents, and two companies from further trespassing on over 15,000 acres of land in Ilara Remo, Remo North Local Government Area.

At the resumed hearing on Monday, the judge ordered that the injunction, first granted on 1 September, remain in place pending the regularisation of court papers by the defendants’ counsel.

The case, marked HCS/377/2025, was originally filed on 18 August 2025.

The affected companies are Industrial Platform Remo Limited and Arise Integrated Industrial Platform.

Both, according to the claimants, had begun erecting structures and alienating portions of the disputed land with the backing of the state government.

Dr Olumide Ayeni (SAN), counsel for the claimants, urged the court to extend the injunction to preserve the status quo ante bellum.

He argued that his clients were the rightful owners of the land, adding that damages would not be sufficient remedy if judgment were ultimately delivered in their favour.

Counsel for the defendants, including Mr M.O. Enitan representing Governor Abiodun, admitted that they were yet to regularise their filings. This prompted the court to adjourn further hearing until 13 January 2026.

The injunction application was initially filed by prominent leaders of Ilara Remo, including the Lisa of Ilara Remo, Chief Samuel Olukoya Sodunola, and supported by 22 others, among them members of the Ilara Remo Development Association.

In their suit, they sought to restrain the governor, his officials, and the companies from trespassing, alienating, or otherwise interfering with the land, measuring 15,309 acres and described in Survey Plan No. IL/02/PROV/1998 of 18 June 1998.

The court’s decision by Justice O.S. Oloyede is seen as a significant step in protecting community land rights while the substantive matter is being determined.
