Justice O.S. Oloyede of the Ogun State High Court, sitting in Sagamu, issued the interim order on Monday following an ex parte application and affidavit of urgency filed by Ilara Remo chiefs, leaders, and representatives of the Ilara Remo Development Association.
The applicants, led by Chief Samuel Olukoya Sodunola (Lisa of Ilara Remo), Chief Babatunde Ogunfeso (Oliwo Egudu of Ilara Remo), Chief Ayedun Akintoye (Olootu Asipa Oje of Ilara Remo), and Mrs. Remilekun Ogunfuwa, argued that they are the legal and beneficial owners of the land as described in Survey Plan No. IL/02/PROV/1998.
Counsel to the applicants, Dr. Olumide Ayeni, SAN, maintained that the defendants were already erecting structures and alienating parts of the land despite the pending suit, describing it as an attempt to foist a fait accompli on the court.
He added that damages alone would not suffice if judgment ultimately favored the community, warning that without restraint, the land could be irreversibly compromised.
Justice Oloyede ruled that the application had merit and therefore granted the Ogun land dispute court injunction, restraining all defendants from further trespass or alienation of the disputed land pending determination of the motion on notice.
The case has been adjourned until Monday, September 1, 2025, for further hearing.
