Attorney General withdraws criminal case against Mike Ozekhome

The Attorney General of the Federation withdraws criminal charges against senior advocate Mike Ozekhome. FCT High Court strikes out three-count forgery case

The Office of the Attorney General of the Federation (AGF) has withdrawn the criminal charge filed against senior advocate Mike Ozekhome over alleged forgery.

The withdrawal was announced on Tuesday at the High Court of the Federal Capital Territory in Maitama, Abuja.

The Director of Public Prosecution of the Federation, Rotimi Oyedepo (SAN), informed Justice Peter Kekemeke that the Attorney General had decided to review the case holistically and determine the most appropriate course of action.

Following the application, which was unopposed by Ozekhome’s defence team led by Paul Erokoro (SAN), the court struck out the three-count charge against him.

Ozekhome had been arraigned on allegations of forgery, fraud, and use of false documents, filed by the Independent Corrupt Practices and Other Related Offences Commission (ICPC).

The charges related to a disputed property at 79 Randall Avenue, London, and the alleged use of a forged Nigerian passport in support of the property claim.

On January 29, 2026, Oyedepo informed the court that the AGF had taken over the prosecution from the ICPC, citing Section 174 of the Constitution, which empowers the Attorney General to institute, take over, or discontinue criminal proceedings.

He explained that the decision, made in collaboration with the ICPC, aimed to ensure the prosecution meets high standards of effectiveness, diligence, and due process, while protecting the rights of the defendant and maintaining public confidence in the justice system.

Justice Kekemeke subsequently granted the application and struck out the charges, officially ending the case at the FCT High Court.
