Federal high court Abuja stops Mamuda Beverages from producing Pop Power Energy Drink over trademark infringement

Federal High Court in Abuja orders Mamuda Beverages to stop producing Pop Power Energy Drink over alleged trademark infringement involving Rite Foods’ Fearless brand

The Federal High Court in Abuja has ordered Mamuda Beverages Nigeria Limited to stop producing its Pop Power Energy Drink in its current bottle design over alleged trademark infringement involving Rite Foods Limited’s Fearless Energy Drink.

The ruling was delivered on Friday, May 22, 2026, by Justice B.F.M. Nyako in Suit No. FHC/ABJ/CS/705/2025. The court dismissed Mamuda’s Notice of Preliminary Objection and granted Rite Foods’ motion for interlocutory injunction.

Justice Nyako held that Rite Foods’ complaint was separate from an earlier case between both companies. The court noted that the new Pop Power bottle design bears a strong resemblance to Fearless Energy Drink packaging.

The court restrained Mamuda from further production of the product in its present form pending determination of the substantive suit. It also ordered immediate cessation of production.

The judge further directed Mamuda Beverages to destroy all existing infringing products. The court also ordered a Bailiff, alongside both parties, to conduct inventory before destruction.

The injunction remains in force until the end of the year or final determination of the case. The matter was adjourned to Wednesday, September 23, 2026, for hearing.

The dispute began after Rite Foods accused Mamuda in 2025 of trademark and design infringement over Fearless Energy Drink. That case ended in a consent judgment after settlement terms were agreed.

Mamuda had agreed to stop imitation, destroy infringing products, and redesign its packaging. The company also pledged to avoid further identity imitation.

However, Rite Foods later alleged Mamuda reintroduced Pop Power with only minor cosmetic changes. The company said the product still caused consumer confusion in the market.

Reports also claimed the drink was informally referred to as “small Fearless,” raising concerns over brand distinction.

Rite Foods reaffirmed its commitment to protecting intellectual property rights and fair competition in Nigeria’s beverage industry.
