Custody dispute over orphaned Nigerian child raises complex legal and ethical questions after COVID-19 separation

A Nigerian court is set to determine the future of an orphaned child after a Nigerian lawyer filed legal proceedings seeking to revoke the adoption rights of an American pastor and his wife, arguing that the child should remain in Nigeria under her custody following years of separation caused by the COVID-19 pandemic.

The case, which has attracted significant legal and public attention, centres on a child who was lawfully adopted by the American couple before international travel restrictions disrupted plans to relocate the child to the United States.

According to court filings, the American pastor and his wife completed the legal adoption process in Nigeria and entrusted the child to the Nigerian lawyer while immigration documentation and visa processing were underway.

However, the outbreak of the COVID-19 pandemic in 2020 halted international travel and significantly delayed visa processing, forcing the child to remain in Nigeria for an extended period.

During that time, the lawyer reportedly became the child’s primary caregiver and has now asked the court to revoke the adoptive parents’ legal rights, arguing that the child’s best interests would be better served by remaining in Nigeria.

The legal action has sparked debate over the balance between established adoption rights and the emotional bonds that can develop between caregivers and children during prolonged and unforeseen circumstances.

The American couple maintains that the adoption was completed in accordance with Nigerian law and insists that the temporary caregiving arrangement was never intended to alter the legal parent-child relationship.

The lawyer, on the other hand, argues that the years spent raising the child created a deep parental attachment and that removing the child from the only home known for several years could have lasting emotional consequences.

Family law experts note that adoption orders are generally intended to provide permanence and legal certainty for children.

Revoking an adoption is typically reserved for exceptional circumstances, including evidence of fraud, procedural irregularities or situations where a court determines that the child’s welfare is at serious risk.

The dispute therefore places the court in the difficult position of weighing the legal rights of adoptive parents against arguments centred on the child’s welfare and emotional wellbeing.

Legal practitioners say Nigerian courts, like many jurisdictions, are guided primarily by the principle of the “best interests of the child” when deciding custody and adoption-related matters.

That standard requires judges to consider a range of factors, including stability, continuity of care, emotional development and long-term welfare.

The case also reflects broader challenges that emerged during the COVID-19 pandemic, when international adoptions around the world were delayed by border closures, travel restrictions and prolonged immigration processing, leaving many families separated for months or even years.

The court is expected to examine the circumstances surrounding the adoption, the caregiving arrangement during the pandemic and whether there are sufficient legal grounds to overturn an adoption that was previously granted under Nigerian law.
