Prime Minister Andy Burnham orders tougher sentencing safeguards as rape and serious child sex offenders are removed from planned prison release changes

United Kingdom Prime Minister Andy Burnham on Tuesday announced that offenders convicted of rape, serious child sexual offences and grooming-related crimes will be excluded from the government’s UK early release reforms, following an urgent review prompted by concerns from victims and the wider public.

The decision, announced jointly by the Prime Minister’s Office and the Ministry of Justice in London, marks a significant adjustment to the government’s prison sentencing plans.

It ensures that those convicted of the most serious sexual offences will continue to serve their existing custodial sentences and will not qualify for earlier release under the new Sentencing Act.

The move follows widespread public concern after details of the proposed reforms emerged, with victims’ groups and campaigners warning that easing release rules for serious offenders could undermine confidence in the criminal justice system.

“Keeping the public safe is my top priority. That’s why I asked for an urgent review of the prisoner release scheme,” Burnham said.

“I fully understand the anger, anxiety and distress that’s been caused. I’ve heard that loud and clear.

That’s why we’re making significant changes: offenders who have been sentenced for rape, serious child sex offences and other grooming offences will be excluded from the changes.”

Under the revised policy, rape and serious child sexual offences will join a list of crimes already excluded from the reforms, alongside more than 18,000 prisoners serving life sentences, extended determinate sentences and other offenders considered by the courts to present the greatest danger to the public.

The government also postponed the wider implementation of the sentencing changes from September to October 2026.

Ministers said the delay would give probation services more time to prepare while allowing victims greater input into licence conditions imposed on offenders after their release.

Burnham acknowledged that the government had considered exempting additional categories of offenders but warned that doing so could overwhelm an already overstretched prison estate.

“I want to be honest. I wanted to go even further as I know there will still be concerns about other offenders having their sentence shortened.

But it’s not possible without the prison system reaching capacity and collapsing, which would put public safety at much greater risk,” the Prime Minister said.

To strengthen public protection, Burnham announced tougher community supervision for eligible offenders released under the reforms.

The measures include a presumption of electronic tagging, longer supervision periods, exclusion zones, enhanced GPS monitoring, random drug testing and broader powers for probation officers to restrict activities such as driving or attending certain public venues.

The Prime Minister also highlighted the long-term pressures facing the prison system, revealing that adult male prisons are operating at approximately 98 per cent capacity.

“As a country, we haven’t invested in the prison estate when we should have, going back over a decade. This has created an unacceptable situation, with our adult male prisons now at 98 per cent capacity,” Burnham said.

“That is not good enough. My government will deliver the fastest prison building programme since the Victorian era and do what’s necessary to fix the prison crisis.”

Justice Secretary Alex Norris said the government had strengthened the reforms after reviewing public feedback and consulting stakeholders.

“The Prime Minister and I have reviewed these reforms, listened to the concerns and gone further to protect victims,” Norris said.

“These are decisions no Minister would ever want to take but it is right these sickening crimes are excluded from these reforms.

Victims will also have access to better support and reassurance that offenders leaving prison face tougher supervision and punishment.”

Beyond sentencing changes, the government unveiled a £10 million package aimed at improving support for victims of crime.

The funding will expand victim contact services, provide additional resources for frontline organisations and establish a dedicated national helpline expected to become operational by October.

Officials also confirmed that offenders convicted of rape or serious child sexual offences who complete their prison terms will remain subject to enhanced post-release measures, including 12 months of GPS trail monitoring, strengthened probation supervision and mandatory consideration for placement in approved probation accommodation.

The revised UK early release reforms form part of the government’s broader strategy to address chronic prison overcrowding while maintaining public confidence in the justice system.

Ministers plan to create 14,000 additional prison places by 2031 through an accelerated prison construction programme and increased efforts to remove foreign national offenders from UK prisons.

The changes reflect the difficult balance facing policymakers as they seek to relieve pressure on correctional facilities without compromising public safety.
