Akwa Ibom defilement conviction: court jails man 14 years without fine after evidence proved guilt in child abuse case beyond reasonable doubt

The Akwa Ibom State High Court sitting in Ikot Ekpene on Tuesday convicted and sentenced Ofonime Augustine Etim, a native of Abama village in Abak Local Government Area, to 14 years imprisonment for defiling a 12 year old girl in Ikot Obong Otoro, Abak Local Government Area of the state.

The ruling followed a case arising from an incident on 10 May 2023, when Ofonime Augustine Etim was accused of unlawfully having carnal knowledge of the minor.

The Akwa Ibom defilement conviction was secured after the court examined extensive testimonial and medical evidence presented during the trial.

The victim had been reported missing for several days before she was eventually found with physical injuries and blood stained clothing.

Her condition prompted immediate medical attention and investigation by law enforcement authorities.

The prosecution, led by the State Ministry of Justice, called three witnesses, including the Investigating Police Officer and a medical doctor, while also tendering documentary exhibits to support the charge.

A Consultant Gynecologist gave critical testimony, stating that examination of the victim revealed a 2cm deep vaginal wall laceration and multiple bruises, findings consistent with forceful penetration.

The Investigating Police Officer also testified that the victim was abducted and taken to a residence where the offence was allegedly committed.

The victim’s elder sister corroborated the timeline, telling the court that the child had been missing for days before being discovered and taken to hospital for treatment.

In his defence, Ofonime Augustine Etim denied the allegations and claimed he was falsely accused out of malice. However, the court rejected the defence, describing it as unsubstantiated and unsupported by credible evidence.

Delivering judgment, Justice Augustine D. Odokwo held that the prosecution had proved its case beyond reasonable doubt.

The court relied heavily on the medical findings and witness testimonies, which together established the essential elements of the offence, including the age of the victim, proof of penetration and the identity of the offender.

The judge described the offence as grave and emphasised the importance of protecting children from abuse.

He noted that the law serves both punitive and deterrent purposes, stressing that society must remain vigilant in safeguarding minors.

Ofonime Augustine Etim was consequently sentenced to 14 years imprisonment without the option of a fine.

The court ordered that the time already spent in custody since 13 May 2023 be deducted from the sentence.

Justice Odokwo further directed that the convict’s name be entered into the State Sex Offenders Register, while all exhibits presented during the trial are to remain in court custody pending any appeal.
